PART 1: GENERAL CONDITIONS OF RENTAL OF THE ESTABLISHMENT

ARTICLE 1: GENERAL PROVISIONS

The contract is a tourist rental agreement (or seasonal rental agreement). The rental period is an essential condition without which the contract would not have been concluded. The tenant may not establish their primary residence in the rented property.

The establishment includes 1 accommodation with a respective capacity of 9 people.

The tenant is required to respect the maximum occupancy stated in the rental agreement. Any breach of this clause may result in the immediate termination of this contract, at the tenant's expense, with the rental amount remaining definitively payable to the landlord.

The tenant must arrive on the specified day and at the indicated times. In case of late or delayed arrival, the tenant must notify the landlord.

ARTICLE 2: TERMS OF CONCLUSION OF THE CONTRACT

The rental is confirmed upon payment of a 30% deposit of the total price of the stay:

· is collected by the secure payment system (Stripe) during online booking;

· or to be paid to the landlord's bank account number within 5 days of receiving the electronic booking confirmation (voucher).

The remaining balance of the stay (70%) must be paid by bank transfer no later than 7 days before arrival to the landlord's bank account number.

Any booking made within 7 days of the arrival date is considered late. In this case, the balance of the stay will be paid into the landlord's bank account upon receipt of the electronic booking confirmation (voucher), i.e., before the start of the stay .

In the event of non-payment, the landlord reserves the right to cancel the contract in accordance with the cancellation conditions accepted at the time of booking.

ARTICLE 2 bis: THE GUARANTEE

 

The security deposit, amounting to €300 (price in words), will be paid 7 days before the stay by bank transfer to the landlord's bank account number or deposited in cash upon arrival.

The landlord reserves the right to refuse access to the establishment if the deposit is not paid.

The deposit will be refunded within 7 days of departure if there is no damage to the accommodation, outbuildings and surrounding area.

The security deposit is intended to cover any debts that the tenant may still owe to the landlord upon returning the premises.

In the event of a dispute, the landlord may, at his own risk, retain the deposit until the responsibilities are clearly established.

If it turns out that the tenant does not owe the sums claimed and that all or part of the deposit must be returned, the landlord will owe interest, at the legal rate, on the amount to be returned in the end.

ARTICLE 3: SOLIDARITY

 

In the case of multiple tenants, the person who made the reservation is responsible for the debts and claims of all tenants.

ARTICLE 4: LATE PAYMENT

 

If the landlord does not receive the payments within the allotted time, he may cancel the lease by registered letter or email within 3 days of the scheduled payment date.

This clause does not apply to late bookings.

Any amount owed by the tenant, and not paid 3 days after its due date, shall automatically and without notice accrue interest to the landlord at the legal rate per month from its due date, with interest for any month started being due for the entire month.

ARTICLE 5: CANCELLATIONS – EARLY DEPARTURE – NO-SHOW

a) Cancellation by the tenant

Any cancellation must be notified by registered letter or email and addressed to the landlord.

The cancellation conditions specified in the electronic order form (voucher) apply.

In the event of force majeure (or an act of government) affecting either party:

1. The date of execution of the contract will be postponed to a later date to be agreed between parties (voucher of an amount equivalent to that of the reservation to be deducted on a future stay).

If no agreement can be reached within a period of 18 months, the amounts paid will be fully refunded to the tenant.

2. The contract is cancelled by mutual agreement and all amounts already received by the landlord are refunded to the tenant

b) Cancellation by the landlord

Any cancellation must be notified by registered letter or email and addressed to the tenant.

The cancellation conditions specified in the electronic order form (voucher) apply.

In the event of force majeure (or an act of government) affecting either party:

1. The date of execution of the contract will be postponed to a later date to be agreed between parties (voucher of an amount equivalent to that of the reservation to be deducted on a future stay).

If no agreement can be reached within a period of 18 months, the amounts paid will be fully refunded to the tenant.

c) Premature departure

The tenant's early departure does not result in any refund, even partial, of the price of the stay.

d) Tenant's failure to appear (no-show)

If the tenant does not arrive within 24 hours of the arrival date stated on the contract:

· the reservation becomes null and void by operation of law;

· the payments remain the property of the landlord who reserves the right to claim the balance from the tenant;

· The landlord can dispose of their property.

ARTICLE 6: RESPONSIBILITIES – INSURANCE

 

a) Fire insurance

The tenant must be covered by Fire Insurance (holiday home) for any damage he or she may cause to the building and rented furniture.

The tenant declares, after checking it, that he is covered for such risks by his personal fire insurance (holiday insurance).

In the event of a breach, the tenant undertakes to take out a contract covering this risk, at the latest on the day of entry into the rented property(ies).

b) Family Civil Liability Insurance (private life)

The tenant declares that he is covered by a Family Civil Liability (private life) insurance policy.

In the event of a breach, the tenant undertakes to take out a contract covering this risk, at the latest on the day of entry into the rented property(ies).

ARTICLE 7: DOMESTIC ANIMALS

A small pet (12 kg max) is allowed with the owner's prior agreement. It must be declared to the landlord.

A few conditions apply: the animal cannot go upstairs, nor onto the chairs and armchairs. It must be kept in the laundry room at night and when the tenants are away.

A supplement of €25 per stay will be applied.

ARTICLE 8: USE AND OCCUPANCY OF PREMISES

The tenant agrees to behave respectfully towards the residents and the environment in general (wildlife, plants, various equipment, etc.). They will use the rented property in accordance with its intended purpose and in a prudent and responsible manner.

The tenant must return the property in the condition in which it was received. The tenant is responsible for any loss or damage to the landlord.

Lively parties such as student revelry, stag/hen parties, dance parties… are not allowed.

ARTICLE 9: CLAIMS

Any complaint must be sent to the landlord by registered letter or email within 8 days of the end of the stay. Supporting documents must be attached.

In the absence of an agreement between the parties, only the courts of the judicial district where the accommodation is located have jurisdiction.

ARTICLE 9 bis: MEDIATION OF THE FEDERATION OF GITES AND BED AND BREAKFASTS OF WALLONIA

 

In the absence of an agreement between the parties, they will submit their grievances to the secretariat of the Federation of Gîtes and Bed and Breakfasts of Wallonia, which will attempt to propose an amicable solution.

In the absence of an agreement between the parties, only the courts of the judicial district where the accommodation is located have jurisdiction and they will apply Belgian law.

This clause applies only to establishments that are members of the Federation of Gîtes and Bed and Breakfasts of Wallonia and are up to date with their membership fees.

ARTICLE 10: PASSENGER CHECK

 

The landlord has the right to verify and register the identity of all occupants of the accommodation in accordance with the 2007 law. The tenant must present a valid identity document (identity card or passport). This should be verified with the CGT (General Confederation of Labour).

ARTICLE 11: ACCEPTANCE OF GENERAL TERMS AND CONDITIONS

 

Unless expressly stated otherwise, the tenant is deemed to have read and accepted all the terms and conditions at the latest when booking online, when paying the deposit and/or the balance of the stay, or when taking possession of the establishment.

PART 2: INTERNAL REGULATIONS

Arrival & Departure

Arrival time is scheduled between 5pm and 8pm. For departure, we ask that you leave the Gîte by 12pm.
In case of a delay in your arrival, please inform the person in charge of reservations at +32 (0) 472 40 72 67 .

Cottage capacity

The Gîte Au Moulin Endormier is equipped to accommodate up to 9 people . If the tenant deviates from this rule, the owner reserves the right to refuse entry to the gîte. The tenant will be responsible for the consequences.

Maintenance and cleanliness of the cottage

Upon your arrival, the cottage will be in a state of maximum cleanliness and comfort. Cleaning is included in the rental price. However, we ask that you return the cottage and its contents in a good, tidy, and clean condition (see check-out checklist). The owner reserves the right to charge additional cleaning fees if the property is returned in an unusually dirty condition.
Please respect the sorting instructions . Bins will be provided and instructions will be available to help you.
Please do not throw anything down the toilet that could clog it (diapers, sanitary napkins, tampons, panty liners, grease, food).

Fire alarm

This is a non-smoking property. It is equipped with a smoke detector system. Smokers are asked to go outside. Please do not throw your cigarette butts on the ground, but use the ashtray provided.

Respect for the neighborhood and the environment surrounding the cottage

The cottage is located in a quiet hamlet. Its inhabitants are mindful of their peace and quiet. You agree to behave respectfully towards the inhabitants and the environment in general (wildlife, flora, various facilities, etc.).

The tenant must respect the peaceful nature of the premises and use them in accordance with their intended purpose. All sound equipment is prohibited. The cottage is not a party venue. Quiet hours are from 10 pm to 6 am . Disturbing the peace at night is punishable by law.

Bachelor/bachelorette parties, inviting outside people, etc. are prohibited.

Fireworks are prohibited, by order of the police, throughout the entire municipality.

The cottage can accommodate a maximum of 9 people (including children). No guests other than those who have booked the cottage are allowed. In case of conflict or complaint, the owner reserves the right to exclude disruptive individuals from the cottage.

 

Keys

The front door of the cottage has a key lock. Please be careful never to leave the keys in the locks on the inside!

The key box where you will find the key upon arrival has a code that is regularly updated. Please return the key to the key box upon departure and do not leave the correct code visible.

Drink

Please only burn wood provided by the landowner . Any wood gathered in the forest, or any other method of burning in the stove, is prohibited. (Paper, pizza boxes, etc… DANGER! Grease and wet wood don't mix.)

Parking

Vehicles must remain parked in the designated areas. It is permitted to drive a vehicle up to the door to load or unload belongings. Afterwards, the vehicle must be returned to the parking lot.

GENERAL TERMS OF USE

ARTICLE 1 - PURPOSE AND SCOPE

The Outil Régional de Commercialisation [Walloon regional marketing tool] (hereinafter referred to as the "ORC (by elloha)") is an initiative launched by the non-profit association VISITWallonia, which has its registered office at Place de la Vieille Halle aux Blés, 27 (2nd floor), 1000 Brussels and is registered with the Crossroads Bank for Enterprises (CBE) under number 0888.366.085.

These General Terms of Use (hereinafter referred to as the "GTU") define the rules governing access to and use of the ORC (by elloha), which enables online bookings to be made for tourist services in Wallonia. By accessing the ORC (by elloha), Users unreservedly accept these GTU and acknowledge their legal scope.

VISITWallonia acts as the provider of a technological tool to facilitate booking management for tourist service providers. VISITWallonia is not involved in the services themselves and does not intervene in contractual relationships between tourists and service providers.

If you have any questions about the GTU or use of the ORC, you can contact VISITWallonia by email at the following address: orc@visitwallonia.be.

VISITWallonia reserves the right to modify the GTU at any time. However, the GTU in force at the time of booking shall apply. Users are advised to read these terms carefully before using the ORC (by elloha).

ARTICLE 2 - DEFINITIONS

VISITWallonia: The non-profit association responsible for the implementation and overall management of the ORC (by elloha). VISITWallonia acts as a technical and strategic facilitator, providing high-performance digital tools to promote and support tourism in Wallonia.

- ORC (by elloha): The Outil Régional de Commercialisation is a technological solution developed by the French company Elloha and configured for VISITWallonia to enable booking management for Walloon tourist services. This tool includes an integrated widget on provider websites and a centralized platform as an ancillary service.

- User: Any natural person accessing the ORC (by elloha) to search for, consult or book tourist services. Users can also manage their bookings and access exclusive offers available via the platform.

- Tourist service provider: Any economic operator providing tourist services or activities in Wallonia. Providers may include, but are not limited to, accommodation, tourist attractions, restaurants or event organizers, provided they meet the eligibility criteria defined by VISITWallonia.

ARTICLE 3 - TERMS OF ACCESS AND USE

Legal capacity

To access and use the ORC (by elloha), Users must be at least 18 years old and have the legal capacity required to enter into contracts. By accessing or using the ORC (by elloha), Users represent and warrant that they meet these criteria.

Access conditions

Access to the ORC (by elloha) is free and open for Users. VISITWallonia reserves the right to suspend or modify the access conditions for maintenance, technical or strategic reasons.

ARTICLE 4 - ORC (by elloha) SERVICES

Technical solution

The technical platform supporting the ORC (by elloha) is designed and managed in partnership with the company Elloha, based in Perpignan, France. This collaboration guarantees a reliable and secure digital infrastructure, specifically designed to facilitate the management and promotion of tourist services in Wallonia.

Available tools

VISITWallonia provides Users with a range of features to make it easier to find and book tourist activities in Wallonia. These tools include:

- Booking widget: an integrated tool enabling Users to book services directly on provider websites.
- Centralized platform: an optional service grouping together provider offers for consultation and booking. This feature remains secondary.

These tools are designed to provide optimum User experience, while guaranteeing quick and easy access to tourist services in Wallonia.


ARTICLE 5 - ROLES OF VISITWALLONIA

VISITWallonia acts as a technical facilitator by offering digital solutions particularly suited to the needs of Tourist service providers. These tools, developed in collaboration with technology experts such as Elloha, enable providers to efficiently manage their availability, promote their tourist services and facilitate secure online bookings.

As a facilitator, VISITWallonia focuses on the implementation and maintenance of this high-performance technical environment, designed to simplify interactions between Tourist service providers and Users.

ARTICLE 6 - USER OBLIGATIONS

Compliance with the GTU

The User undertakes to comply with all the provisions of these GTU. Any use contrary to the terms of the GTU may result in sanctions, including suspension of access to the ORC (by elloha).

Accuracy of information The User guarantees that the information provided when using the ORC (by elloha) is accurate, complete and up to date. Any erroneous or misleading information is strictly prohibited.

Responsible use The User undertakes to use the ORC (by elloha) in a responsible and lawful manner. In particular, they shall refrain from:
- Altering or disrupting the operation of the ORC (by elloha);
- Accessing or attempting to access unauthorized sections of the ORC (by elloha);
- Using the ORC for fraudulent, harmful or illegal purposes.

Respect for third parties
The User undertakes not to infringe the rights of other Users, Tourist service providers or any third party in connection with the use of the ORC (by elloha). This includes respecting intellectual property rights and personal data.

ARTICLE 7 – RESPONSIBILITIES

VISITWallonia's responsibilities

VISITWallonia, in collaboration with its technical provider Elloha, shall undertake to maintain a high level of quality and availability of the ORC (by elloha). VISITWallonia shall also endeavor to guarantee the security of Users' personal data and the reliability of transactions carried out via the ORC (by elloha). All necessary technical and organizational measures shall be taken to prevent the risks associated with unauthorized access to or the loss or modification of data.

However, VISITWallonia cannot be held responsible for the consequences of interactions or contracts between Users and providers, nor for any service interruptions due to technical reasons, scheduled maintenance or force majeure.

Relationships with tourist service providers

Users acknowledge that any booking made via the ORC (by elloha) establishes a direct contractual relationship between them and the Tourist service providers. These contracts include, but are not limited to, booking conditions, cancellation policies, payment obligations and the provision and quality of services. VISITWallonia, in its capacity as a technical facilitator, does not intervene in the negotiation, conclusion or execution of these contracts.

Tourist service providers shall be fully responsible for the accuracy of the information they publish on the ORC (by elloha), including availability, descriptions of services, and prices.Similarly, Users must ensure that they fully understand the terms of the services before making a booking.

VISITWallonia cannot be held responsible for the performance or improper performance of contractual obligations arising from these relationships. Any question, claim or dispute relating to the services must be dealt with directly between Users and Tourist service providers. VISITWallonia limits itself to providing technical support for access to the tool and does not play any operational or decision-making role in these contractual relationships.

ARTICLE 8 – FORCE MAJEURE

VISITWallonia shall not be liable for any delay or failure to perform its obligations if such delay or failure is caused by events or circumstances beyond its reasonable control. Such events include, but are not limited to, 'force majeure' such as earthquakes, floods, labor disputes involving third parties, restrictions imposed by public utilities, power failures, explosions, civil disturbances, acts of vandalism, riots, wars and other similar events.

In the event of a force majeure situation, VISITWallonia undertakes to make all reasonable efforts to minimize the impact and damage resulting from such events. We shall aim to resume normal operations and services as soon as possible after the resolution of such situations.

ARTICLE 9 - MODIFICATION OR DISCONTINUATION OF SERVICE

VISITWallonia reserves the right to modify, suspend or discontinue all or part of the ORC (by elloha) services any time and without notice, including for strategic or operational reasons. By using this service, you acknowledge that VISITWallonia may make such decisions, which may affect your use of the ORC (by elloha).

We undertake to communicate any significant modification or interruption as soon as possible in order to minimize any inconvenience to Users.

ARTICLE 10 – ACKNOWLEDGEMENT OF AND COMPLIANCE WITH THE GTS OF TOURIST SERVICE PROVIDERS

Consulting the GTS
Before confirming a booking via the ORC (by elloha), the User undertakes to consult the General Terms of Sale (hereinafter referred to as the "GTS") specifically to the provider in question. These GTS detail the contractual terms and conditions, including cancellation policies, payment terms and conditions and any other applicable obligations.

Complying with the GTS
By confirming a booking, the User acknowledges that they have read and unreservedly accept the GTS of the Tourist service provider. The User undertakes to comply with the terms and conditions set out, including but not limited to the rules governing the use of the services or products booked.

Direct relationship with the Tourist service provider
The User accepts that any booking made via the ORC (by elloha) constitutes a direct contractual relationship between them and the Tourist service provider. VISITWallonia does not intervene in these contractual relationships and cannot be held responsible for the performance or improper performance of the obligations defined in the GTS.
Disputes relating to the GTS
In the event of a dispute relating to the application of the GTS, the User is invited to directly contact the relevant Tourist service provider.

Streitigkeiten im Zusammenhang mit den AGB
Im Falle von Streitigkeiten über die Anwendung der AGB wird der Nutzer gebeten, sich direkt mit dem betreffenden Tourismusanbieter in Verbindung zu setzen.

ARTICLE 11 - INTELLECTUAL PROPERTY

The ORC (by elloha), including its concept, source codes and technical structure, is the exclusive property of Elloha. The content of tourist services, such as descriptions, rates and associated conditions, shall remain the property of the providers.
Any reproduction, modification or commercial use of the elements accessible via the ORC (by elloha) is strictly prohibited without the prior written authorization of the respective owners. Any infringement may result in prosecution.

ARTICLE 12 - PROCESSING OF PERSONAL DATA

VISITWallonia may process Users' personal data in compliance with current legislation.
Full information on the use of personal data is contained in the data protection policy accessible via the following link, which the User acknowledges having read.

ARTICLE 13 - APPLICABLE LAW AND COMPETENT COURTS
The GTU are governed by Belgian law. However, if the User is acting as a consumer within the meaning of applicable law, they shall also benefit from the mandatory provisions of the law of their country of residence, when these are more favorable to them.
This clause does not affect the mandatory rights of consumers to have recourse to alternative dispute resolution mechanisms or to bring an action before the competent courts as provided for by their national legislation.

ARTICLE 14 - FINAL PROVISIONS
The fact that VISITWallonia does not avail itself, at one time or another, of one of the provisions of the GTU may not be interpreted as a waiver by VISITWallonia of its right to do so at a later date.
The invalidity or unenforceability of any provision of the GTU shall not affect the validity of the other provisions, which shall remain in full force and effect.

VISITWallonia is classified as a type 3 organisation as referred to in the decree of 15 December 2011 on the organisation of the budget, accounting and reporting of Walloon public administration units. It is entrusted with public interest missions as defined in article 31/4.D. of the Walloon Tourism Code, the aim of which is to promote the heritage, infrastructure and tourism initiatives of the French-speaking region.

It is in the context of these missions entrusted to VISITWallonia that all processing of Personal Data is carried out within VISITWallonia.

• all players in the tourism, cultural and HoReCa sectors and professional associations.

2. VISITWallonia employees in Belgium and abroad in the performance of their duties.

3. Subcontractors and external service providers.

VISITWallonia may need to disclose your Personal Data in order to (a) comply with applicable laws, court orders or subpoenas, and/or (b) protect and defend its rights or the rights of persons affected by the processing of such Personal Data.

In each case, VISITWallonia will ensure that such disclosure is in accordance with the law and safeguards your essential data protection rights.

STORAGE AND TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

Your Personal Data is stored in Belgium or elsewhere in the European Economic Area, thus guaranteeing equivalent protection.

In such cases, VISITWallonia makes every effort to ensure that these recipients provide adequate protection. Right of access

You have the right to ask VISITWallonia for the Personal Data it holds about you. This right gives you the opportunity to request a copy of all or part of your Personal Data, if you so wish.

Where the processing of your Personal Data is based exclusively on the performance of one of VISITWallonia's public interest tasks, you have the right, on grounds relating to your particular situation, to object to such processing.

However, VISITWallonia may refuse your request to object if it can demonstrate compelling legitimate grounds for processing your Personal Data.

Right of rectification

You have the right to ask VISITWallonia to correct information that is incorrect.

Right of limitation

You have the right to obtain the limitation of the processing of your Personal Data when:

• You challenge the accuracy of your Personal Data, for a period allowing VISITWallonia to verify the accuracy of such data.
• the processing is unlawful;
